Terms and Conditions

Customer Requirements

The client represents and warrants that is at least eighteen (18) years old and that all registration information submitted is accurate and truthful. If the client using the services on behalf of any entity, the client represents and warrants that is authorized to accept these terms and conditions on such entity’s behalf and that such entity agrees to be responsible to Mint Picnics if the client or such entity violates these terms and conditions.

Quotes
  • Unless otherwise stated in writing, Mint Picnics quotes will be valid for a period of up to ten days from the date the quote was issued.
  • Quotes will be confirmed as a booking when the 50% retainer has been received by Mint Picnics.
Retainers
  • A non-refundable retainer of 50% is required to secure a Mint Picnics booking date and time.
  • Retainers should be made by the client on or before the due date as stated on the invoice and confirmation request/e-mail.
Payment Conditions
  • All payments are strictly due as detailed in the Mint Picnics invoice/confirmation e-mail to the client. Payments should be made by way of bank transfer ie. PayPal or Zelle. 
  • Mint Picnics bookings cannot be confirmed without a 50% retainer. Failure to pay an invoice in full may result in the cancellation of a booking and loss of retainer.
Cancellation/Reschedule/Rain
  • We do not offer refunds, but we can change your reservation time without a penalty up to 72 hours before your Mint Picnic. After that, if you decide to reschedule, there will be a 50% fee to move your reservation (up to 6 months to have the rescheduled event).
  • If the forecast predicts a 50% chance of rain or more on the day of your event, we can arrange to deliver the picnic to an indoor location (can be at the comfort of your home) or we can simply reschedule your booking (up to 6 months). If you prefer taking the risk to proceed with your scheduled picnic, we ask that you sign a waiver stating you acknowledge the chance of rain and accept that Mint Picnics does not offer any refunds.
  • The client has a 6-month limit following the canceled event for rescheduling and must be of equal or higher value. Mint Picnics. will apply the Client’s original 50% non-refundable retainer toward this rescheduled event if it is within 6 months of the original Event Date.
Loss or Damage to Picnic Rental Items
  • All picnic rental items supplied to the client, are property of Mint Picnics unless otherwise stated in a signed invoice.
  • Damage to or loss of rental items within the time of booking as detailed in the invoice will be reported by the client to Mint Picnics immediately. 
  • If the rental items are lost or damaged, the client must pay to Mint Picnics the current replacement/repair cost of the picnic rental items.
Alcohol Consumption
  • It is the responsibility of the client to check the alcohol laws of any location or public space being used for one of our picnics.
  • Most public parks and beaches prohibit alcohol consumption. Mint Picnics takes no responsibility for any alcohol consumption or penalties that occurred.
Location
  • We can deliver to the client’s home (indoor or outdoor setup), a private hotel room, public parks, and beaches click here for a list of our fave locations, we will do our best to arrange in any other location, not on our fave list; delivery fee varies depending on location and access. All deliveries are charged as follows; Kendall, South Miami, Coral Gables, Coconut Grove, Pinecrest, Doral $55-$65, Key Biscayne $75, South Beach $85, North Beach/Ft. Lauderdale $95. Beach deliveries are charged based on proximity and access, same for large events and home deliveries. Parks with an entrance, parking or valet fee require a higher rate (please note, all parks and beaches in Miami, FL are public, and we cannot control if there are people around).
Weather for Outdoor Picnics
  • The weather in Miami is unpredictable, the client is responsible for wearing fresh clothes for the Miami heat and know that at times the wind might be strong and sand will be on the way. Mint Picnics is not responsible for any sand touching or sticking to any exposed food add-ons like cupcakes and food trays.
  • If the wind is over 10mph the boho umbrella included in all setups will not be open, and for the tent, if it is over 15mph the structure will be put with no canopy, just decor at the top as seen in pics.
Security
  • The client is responsible for the supervision and security of Mint Picnics rental items until the end of the reservation when Mint Picnics returns and packs up.
  • If rental items are stolen from the location; The client shall notify in writing stating the full circumstances of the theft and the time the police were notified, until Mint Picnics receives such notification, the rental charges will continue. The client agrees to cover the costs to replace items stolen under the supervision of the client during the period of hire using the incidental deposit.
Incidental Deposit
  • The client agrees to pay the incidental deposit when booking in case of damage or lost items/furniture during the picnic.
  • The incidental deposit is refunded by Mint Picnics to the client via Zelle within 24 hrs after the event has ended if everything is still in good condition (no damage or lost items).
Assumption of Risk
  • During the client’s use of any Mint Picnic experiences, the client may face certain risks and hazards, both foreseeable and unforeseeable. These risks and hazards include, but are not limited to, the following: travel and navigation in difficult terrain and inclement weather; inadequate food and/or water supplies; accidents or collisions involving planes, trains, automobiles, or other modes of conveyance; acts of terrorism, vandalism or war; storms, earthquakes or other natural disasters; government restriction or regulation; theft or other criminal acts; and accident or illness in remote locations without access to medical facilities. 
  • These risks and hazards may result in physical injury, sickness or death, and damage to, or loss or destruction of property, and no guarantee can be made that Mint Picnics or others can aid if any of the foregoing results.
  • Client hereby acknowledges that the use of a Mint Picnic experience involves inherent risks of physical injury, illness, death, and/or damage to or loss of property, that clients participation is entirely voluntary and that client elects to assume all such risk and use Mint Picnics and engage in associated activities with full knowledge of the inherent risks.
Indemnification

Client agrees to indemnify, defend and hold Mint Picnics, its subsidiaries, affiliates, officers, agents, employees, and partners harmless from any liability, claim, demand, administrative action, cause of action, suit, damage, loss, cost, or expense, including reasonable attorneys’ fees, made by any third party due to or arising out of any content or information client submits, posts, transmits, modifies or otherwise makes available on mintpicnics.com or to third parties with whom the client is in contact via this website, including but not limited to any confidential information, clients violation of this Terms and Conditions, or violation of any rights of another.

Limitation of Liability

EXCEPT AS EXPRESSLY OUTLINED IN THIS AGREEMENT, MINTPICNICS DOES NOT MAKE ANY EXPRESS OR IMPLIED WARRANTY AND, IN PARTICULAR, DOES NOT MAKE ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. 

FURTHER, THE COMPANY MAKES NO WARRANTY THAT THE CLIENT OR THE CLIENTS PROPERTY WILL NOT BE DAMAGED OR HARMED IN THE USE OF MINT PICNICS SERVICES, OR AS TO THE QUALITY, ACCURACY, TIMELINESS, TRUTHFULNESS, COMPLETENESS, CURRENCY, OR RELIABILITY OF ANY CONTENT OR SERVICES.

IN NO EVENT WILL MINT PICNICS, OR ITS AFFILIATES, BE LIABLE CONCERNING ANY SUBJECT MATTER OF THIS AGREEMENT UNDER ANY CONTRACT, NEGLIGENCE, STRICT LIABILITY OR OTHER LEGAL OR EQUITABLE THEORY FOR (I) ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES; (II) THE COST OF PROCUREMENT FOR SUBSTITUTE PRODUCTS OR SERVICES; OR (III) FOR ANY AMOUNTS THAT EXCEED THE FEES PAID BY YOU TO MINT PICNICS UNDER THIS AGREEMENT DURING THE TWELVE (12) MONTH PERIOD BEFORE THE CAUSE OF ACTION.

MINT PICNICS SHALL HAVE NO LIABILITY FOR ANY FAILURE OR DELAY DUE TO MATTERS BEYOND THEIR REASONABLE CONTROL. THE FOREGOING SHALL NOT APPLY TO THE EXTENT PROHIBITED BY APPLICABLE LAW. THE LIMITATIONS OF DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN YOU AND US.

Image Release

If photos of the clients Mint Picnic experience have been taken and shared either on social media or with Mint Picnics, Mint Picnics reserves the right to use such images in its promotional materials, unless specified otherwise by the client. In which case, it is handled, on a case-by-case basis.

Electronic Signature

The client agrees that the use of Mint Picnics services constitutes the client’s electronic signature, acceptance, and agreement under the United States federal E-SIGN legislation and will meet the requirements of an original signature. The client may not raise the use of an electronic signature as a defense to the enforcement of this Agreement.  

Interpretation*
  • Mint Picnics” means us, the business responsible for the booking package and rental of items.
  • The Client” means the person or business who will be renting items and to whom the invoice is addressed.
  • Rental Items” means all furniture, pillows/cushions, glassware, tableware, flatware, linens, decor, and misc. accessories in the Mint Picnics experience, rented by the client from Mint Picnics.
  • Retainer” means a non-refundable fee, paid to Mint Picni
